“731新政”后 深圳市国土委再发新《通知》

继7月31日深圳市发布《关于进一步加强房地产调控促进房地产市场平稳健康发展的通知》(简称“731新政”)后,昨天,市规划国土委又发布《深圳市规划和国土资源委员会关于贯彻落实市政府房地产调控政策的通知》(以下简称《通知》),出台关于“731新政”的执行细则。

根据《通知》要求,2018年7月31日(含7月31日)已经取得进展的4类项目不划进商务公寓限售范围;2018年7月31日(含7月31日)前已经签订买卖合同并已为购房支付相关费用的,能提供相关材料即可视为已办理网签(预)录入,但应当在2018年10月31日(含10月31日)之前申请登记;个人购房限售时间会在不动产权利证书“附记”栏中有记载。

“731新政”共包括了四个要点:企业限购、商务公寓限售、个人限售和抑制离婚炒房,此次发布的《通知》针对上述四个要点做了进一步补充和完善,尤其是在“731新政”中关于商务公寓限售的规定,因存在“一刀切”或会“误伤”已经取得进展的城市更新、土地整备等项目,《通知》对此做了进一步明确:2018年7月31日(不含7月31日)后,各类用地上建设的商务公寓一律只租不售且不得改变用途,但有四种情形例外。

在企业限购方面,《通知》规定了具体的限购时间。2018年7月31日(含7月31日)之前,企事业单位、社会组织等非自然人购买的住房,可继续完成交易,购买的时间以网签录入时间为基准;2018年7月31日(不含7月31日)之后非自然人购买商品住房的,不予办理转移登记。

在新购商务公寓和住房的管理方面,《通知》要求,2018年7月31日(含7月31日)之前购买的商务公寓和住房,不在禁止转让之列,购买的时间以网签录入时间为基准;2018年7月31日(不含7月31日)之后购买且属禁止转让范围的,商务公寓自登记之日起5年内、商品住房自登记之日起3年内不予办理转移登记,并在不动产权利证书“附记”栏中记载:根据深府办规〔2018〕9号文规定,XXXX年XX月XX日前禁止转让。

2018年7月31日(含7月31日)前更新单元规划已经批准(含规划修改或者调整情形)的,批准的更新单元规划中确定的商务公寓,但不包括2018年7月31日(含7月31日)后更新单元规划修改或者调整增加的商务公寓部分。

在2018 年 7 月 31 日(含 7 月 31 日)之前已签订房地产买卖合同并已为购房支付相关费用,具备(预)录入条件,但因客观原因尚未在房地产信息系统中(预)录入房地产买卖合同信息的,这种情形该怎么办?

《通知》规定,能提供以下证明材料之一的视为已办理网签(预)录入:

(1)支付购房定金、部分或者全部房款(不含现金支付)的银行转账有效凭证(POS机购房签购单、购房转账单等);

(2)购房资金监管协议及支付相应费用的银行转账有效凭证。

《通知》要求,提供上述材料申请一手房(现售)和二手房转移登记的,应当在2018年10月31日(含10月31日)之前申请登记。
 
The Notice requires that those who apply for the transfer registration of first-hand and second-hand houses with the above materials should apply for registration before October 31, 2018 (including October 31).
 
 
 
《通知》还规定,因继承、受遗赠、离婚财产分割取得的房地产,禁止转让的时间以继承、受遗赠、离婚财产分割前最近一次转移登记的时间起算。
 
The Notice also stipulates that the time for forbidding the transfer of real estate acquired through inheritance, bequest and divorce property division shall start at the time of the last transfer registration before the division of inheritance, bequest and divorce property.
