注意!东莞房子租给无身份证的人将被罚款 办理房屋租赁需要什么

《东莞市出租屋治安与消防安全管理条例》将于12月1日开始实施。《条例》填补了地方立法空白,为东莞市出租屋治安与消防安全管理工作提供规范和指引。
 
The regulations on the management of public rental and fire safety in Dongguan will be implemented in December 1st. The Regulations fill the gaps in local legislation and provide norms and guidelines for the public security and fire safety management of rental housing in Dongguan.
 
 
 
 
 
《条例》明确了出租人、管理人的治安安全责任,其中针对《治安管理处罚法》第五十七条中“房屋出租人将房屋出租给无身份证件的人居住的……处二百元以上五百元以下罚款”的规定,根据东莞市出租屋管理实践中的特殊情况作出了更细致的规定。

东莞市公安局就《条例》第十四条第(一)至(五)项规范的是出租人、管理人的治安安全责任进行了解读。
 
Dongguan Municipal Public Security Bureau has interpreted the public security responsibility of the lessor and the administrator as stipulated in Items (1) to (5) of Article 14 of the Regulations.
 
 
 
条文原文:不得向未提供有效身份证件或者证明的自然人、未提供营业执照或者其他有效证明的法人和其他组织出租房屋。(第十四条第一项)
 
The original text of the clause: It is forbidden to lease houses to natural persons without valid identity documents or certificates, legal persons without business licenses or other valid certificates and other organizations. (item fourteenth, item 1)
 
 
 
解读:《治安管理处罚法》第五十七条规定,“房屋出租人将房屋出租给无身份证件的人居住的……处二百元以上五百元以下罚款。”在我市出租屋管理实践中,存在以下两种特殊情形:一是存在企事业单位租赁某栋或者某几栋房屋,提供给本单位职工居住;二是少数群众在遗失身份证件后有租赁房屋居住需求。针对上述两种情形,我市在立法过程中进行了细化和明确。出租人、管理人可以向持公安机关开具的有效身份证明的群众和提供营业执照或者其他有效证明的法人和其他组织出租房屋。
 
Interpretation: Article 57 of the Law on Administrative Penalties for Public Security stipulates that "the lessor of a house leases the house to a person without an ID card to live in... A fine of more than two hundred yuan or less than five hundred yuan. " In the practice of rental housing management in our city, there are two special situations: one is the existence of enterprises and institutions leasing a certain house or several houses for their employees to live; the other is a small number of people in the loss of identity documents after the rental housing needs. In view of the above two situations, our city has refined and clarified in the legislative process. The lessor or the administrator may lease the house to the masses who hold the valid identity certificate issued by the public security organ and to legal persons and other organizations that provide business licenses or other valid certificates.
 
 
 
《房屋租赁许可证》需要提供以下资料

一、出租方

1、房屋所有权证或其他合法的权属证明;
